FAQ on the scope of license and the extended license

We will update the Terms of Use of both PIXTA and Imasia on January 30, 2015.

Through the updates this time, the scopes of the standard license and the extended license provided in the Articles 6 and 7 of the Terms of Use respectively will be reviewed, and updated so as to improve the usability for the users of our service and the available content, for example, with simpler criteria to determine the uses which exceeds the standard license and requires acquisition of the extended license.

We present here the detail of the updates so you can continue to use our service and contents smoothly after they become effective.

3. Adding text or any other material or simple montages over the Content.

*Alteration of the Content is still subject to the prohibitions as in the Terms of Use.

Q. Can I use the Content purchased before the updates within the previous scope of the license?
A.No, the uses of the Content after the updates on January 30, 2015 shall be subject to the scope of license under the updated Terms of Use.

Q. When using for broadcasting or video distribution, the extended license was required regardless of the copyright notice being displayed or not under the former Terms of Use. How about after the updates?
A.After the updates, if the prescribed copyright notice is displayed, the Content may be used without obtaining the extended license. However, otherwise, the extended license is required even under the updated Terms of Use.

Q. When using for digital signage such as public screening, train channels, videos for events, or shop fronts etc., the extended license was not required under the former Terms of Use. How about after the updates?
A.After the updates, such use in the digital signage will be categorized into the “Use in the broadcasting, display, video distribution” which is permitted within the standard license only if the prescribed copyright notice is displayed.

Q. If the Content is used for the video distribution, once the prescribed credit notice is displayed, may further uses in the same category be permitted under the standard license without the credit notice?
A.No, the credit notice will be necessary upon every use for the broadcasting or video distribution if you do not obtain the extended license. If any use among multiple uses or secondary use for the category is done without the credit notice, the extended license should be purchased additionally.

Q. When using with the products for sale, the extended license was required if the number of reproduction was 3,000 or more. How about after the updates?
A.As the scope of uses permitted under the standard license will be broadened through the updates this time, with products for sale, the extended license will be required once the number of reproduction (including the number of delivery and download) is 300,000 or more in aggregate, except for the products as set forth in the “Sale of certain products” such as T-shirts, mugs, postcards, greeting cards, stickers and stamps, and templates of all kinds, for which usage will require the extended license regardless of the number of reproduction.

Q. If the Content purchased before the updates has already been reproduced in less than 3,000 copies in products for sale such as magazine or books under the standard license, will the current number of copies be counted with the new 300,000 copies limit for requiring the Extended License?
A.For the user’s convenience, the count of reproduction will restart on January 30, 2015. Any use in which reproduction is exceeding 300,000 or more after the updates will require the extended license.

Q. When using with digital content distributed for free (such as free apps), the extended license was not required regardless of the number of reproduction. How about after the updates?
A. The extended license will be required for digital content of all kinds if the reproduction exceeds 300,000 or more regardless that it is charged or not upon the distribution .

Q. When using with the products for sale, the extended license was required regardless of the number of reproduction. How about after the updates?
A.As the scope of uses permitted under the standard license will be broadened through the updates this time, with the products for sale, the extended license will be required once the number of reproduction (including the number of delivery and download) is 300,000 or more in aggregate, except for the products as set forth in the “Sale of certain products” such as T-shirts, mugs, postcards, greeting cards, stickers and stamps, and templates of all kinds, the use for which will require the extended license regardless of the number of reproduction.

Q. Before the updates, the extended license was required for digital contents regardless that it was charged or not. How about after the updates?
A. The extended license will be required for digital contents of all kinds regardless that it is charged or not upon the distribution if the reproduction exceeds 300,000 or more. If the number of reproduction of the Content is less than 300,000, such use will be permitted without the extended license.
